As of 2026 Australian law, family violence is legally defined as threatening, dominating, coercive, or abusive behaviour occurring between individuals in a family or relationship context. This includes physical, emotional, psychological, social and financial abuse.
Australia operates on a “no fault” divorce system, meaning the only ground for divorce is the irreconcilable breakdown of the marriage, demonstrated by a 12-month separation of both parties. The court does not consider reasons such as adultery or desertion when divorce is filed for.
Filing for divorce can be done online through the website of the Federal Circuit and Family Court of Australia, through either a solo or a joint application. There’s a lodgement fee and relevant documents will be asked for, such as marriage certificates.
The parent’s ability to provide a stable home environment, the child’s age, wishes, and safety, the child’s relationship with each parent and the willingness of each parent to support the child’s relationship with the other parent are all factors considered when deciding on child custody. A demonstrable case of the other parent’s neglect or mistreatment (such as a history of family violence) can be grounds for receiving full custody of your child.
