Criminal Law

Criminal matters can be difficult to deal with alone and they can get emotionally draining. If you are charged with a criminal offense, stop. Take a breath. The next few hours will shape your entire case.

1. Stay silent: You’re only required to give police your name and address. Beyond that, you have the right to remain silent.

2. Call a lawyer immediately: Don’t delay. The sooner you speak with a criminal defense lawyer, the better.

3. Don’t sign anything: Avoid making statements or signing documents without legal advice.

4. If you’ve been charged, save any relevant messages, photos, or communications. These could become an important evidence later.

5. If the police want to speak with you, or you’ve just been charged, you don’t need to face it alone. Call us immediately. Our legal team is available around the clock to protect your rights from the first moment.

What Are the Timeframes for Criminal Proceedings?

The timeline of a criminal matter can vary greatly, depending on the nature of the charge and which court handles the case.

Here’s a general guide:

  • Minor offenses (summary matters) may be resolved in one or two court appearances
  • More serious matters may require several months of mentions before hearing
  • Committal proceedings for indictable charges usually occur within 3–6 months of charges being laid
  • District or Supreme Court trials may be listed 6–18 months after committal
  • Appeals must generally be lodged within 28 days from the court decision

We keep you informed at every step, so you understand what to expect and how best to prepare.

What Costs Are Involved in Criminal Defense?

The cost of legal representation depends on a number of factors:

  • The complexity of your case
  • The seriousness of the charge
  • How long the matter runs
  • Whether the case proceeds to trial

AVO

If you've received an Apprehended Violence Order or Domestic Violence Order, understand that breaching it is criminal. We help respond to AVOs, negotiate fair conditions, fight unjust claims, protect parental rights, and avoid breach charges with confidential support.

Violent Crime

At Sultan Legal, we help clients with arguing self-defence, provocation, or necessity, raising mental health or capacity issues, contesting mistaken identity or unreliable witnesses, disputing whether force was used at all, and questioning whether the accused had the necessary intent.

Young Offenders

Young people facing criminal charges need representation that is both firm and understanding. The youth justice system prioritizes rehabilitation over punishment, and we work to ensure that a mistake doesn't define a child's future.

White Collar Crime

Allegations of white collar crime can carry legal penalties as well as professional ruin. We can help you with cases involving fraud, embezzlement, misuse of funds, needing complex documents and financial systems requiring expert analysis.

Criminal Appeals

A conviction doesn't always mean the fight is over. If something went wrong during your trial, or if you feel your sentence was unjust, or there's new evidence, an appeal might be possible. Sultan Legal handles criminal appeals under the Criminal Appeal Act.

Regulatory Offenses

We can help drafting these agreements as they need to tick following legal boxes: both parties get independent legal advice, full disclosure of finances, proper formalities including signing, witnessing, and following timelines.
